These terms of use (“Terms”) govern your access to and use of the Statellite website, mobile apps, and related services (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. Please read them carefully.
Acceptance of Terms
By using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not use our Services. If you are using the Services on behalf of a team, club, or organization, you represent that you have the authority to bind that organization to these Terms.
Changes to Terms
We may modify these Terms from time to time. When we do, we will update the Effective Date above and, for material changes, notify registered users via email or in-product notice. Your continued use of the Services after the changes have been posted constitutes your acceptance of the updated Terms.
Use of Services
You agree to use the Services only for lawful purposes and in a manner consistent with their intended use. You agree not to:
- Violate any applicable laws, regulations, or athletic governing-body rules.
- Upload, share, or otherwise process an athlete's personal information without the consent required by law and your program's policies.
- Infringe on the intellectual property, publicity, or privacy rights of coaches, athletes, parents, or third parties.
- Use the Services to transmit harmful, abusive, or misleading content, including fabricated performance data.
- Interfere with or disrupt the integrity or performance of the Services, or attempt to circumvent access controls.
Account Registration
To access certain features of the Services you may need to register for an account. You agree to provide accurate and complete information when registering and to keep that information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
Accounts used to manage athletes under 13 must be held by a coach, parent, or legal guardian who has completed the age-appropriate consent flow described in our Children's Privacy policy.
Evaluations, NOVA, and Performance Data
Statellite offers tooling for scheduled and live athlete evaluations, including the NOVA score. NOVA is a derived metric intended to support, not replace, coaching judgment. Evaluation results, projections, and NOVA outputs are provided on an informational basis and are not a guarantee of athletic outcomes, recruitment results, or eligibility decisions.
You are responsible for ensuring that any data you enter — test results, athlete profiles, roster information — is accurate and collected in accordance with applicable law and your organization's policies.
Paid Services and Subscriptions
Some Services are offered on a paid basis. Fees, billing frequency, and renewal terms are presented on the Pricing page and in your order or purchase confirmation. Unless otherwise stated, paid subscriptions renew automatically at the end of each billing cycle. You can cancel renewal from your account settings before the next billing date.
Privacy
Your use of the Services is also governed by our Privacy Policy. By using the Services, you consent to the practices described in the Privacy Policy, including how we collect, use, and share information about coaches, athletes, and program operators.
Intellectual Property
All content, features, and functionality of the Services — including text, graphics, logos, software, and the NOVA model — are the exclusive property of Statellite, Inc. or its licensors, and are protected by intellectual-property laws. You may not reproduce, distribute, or create derivative works from any part of the Services without our prior written permission, except as expressly permitted by these Terms.
You retain ownership of the athlete, roster, and program data you or your organization uploads to the Services. You grant Statellite a limited, worldwide license to host, process, and display that data solely to provide and improve the Services.
Termination
We may terminate or suspend your access to the Services at any time, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Services will immediately cease. Sections of these Terms that by their nature should survive termination — including ownership, disclaimers, limitations of liability, and dispute resolution — will continue to apply.
Disclaimers
The Services are provided “as is” and “as available” without any warranties of any kind, either express or implied. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components, or that NOVA or any evaluation output will meet a particular recruiting, selection, or performance standard.
Limitation of Liability
To the fullest extent permitted by law, Statellite, Inc. and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of the Services — even if we have been advised of the possibility of such damages.
Governing Law
These Terms are governed by and construed in accordance with the laws of the State of South Carolina, United States, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Services will be resolved exclusively in the state or federal courts located in South Carolina.
